Terms of Use

MetroEngines K.K. (hereinafter referred to as “our company”) establishes the following terms and conditions (hereinafter referred to as “Terms”) for the web media service “HotelBank” (hereinafter referred to as “the Service”) operated and provided by our company. Users of the Service (hereinafter referred to as “Users”) may use the Service in accordance with the following terms, and by using the Service, Users are deemed to have agreed to these Terms.

1. Our company may change, interrupt, or terminate the Service at its discretion in the following cases:
a) When urgent inspection or maintenance work is required for the computer system related to the Service.
b) In the event of a computer or communication line failure due to an accident.
c) In cases where the operation of the Service becomes impossible due to force majeure such as earthquakes, lightning, fires, floods, power outages, or other natural disasters.
d) In other cases deemed necessary by our company.

2. Users shall use the Service through the operation of a PC, smartphone, tablet device (hereinafter referred to as “device”) at their own expense.

3. All intellectual property rights, portrait rights, publicity rights, ownership, and other property rights (hereinafter referred to as “Intellectual Property Rights, etc.”) related to the text, images, videos, and all other information (including linked content, hereinafter referred to as “Content”) that constitute the Service belong to our company or third parties who have these rights.

4. Users shall not engage in, or attempt to engage in, any of the following acts, or acts deemed as such by our company, in using the Service:
a) Acts that violate laws or are related to criminal activities.
b) Acts against public order and morals.
c) Acts that infringe the intellectual property rights, etc., of our company, other users of the Service, or third parties.
d) Transmitting information containing computer viruses or other harmful computer programs to our company, other users of the Service, or third parties.
e) Acts that impose an excessive burden on the system of the Service.
f) Acts that interfere with or may interfere with the operation of the Service.
g) Unauthorized access or attempts of unauthorized access to our systems.
h) Collecting information of other users of the Service.
i) Acts that cause disadvantage, damage, or discomfort to our company, other users of the Service, or third parties.
j) Acts that directly or indirectly induce or facilitate the above acts.
k) Other acts deemed inappropriate by our company.

5. Our company does not guarantee the accuracy, completeness, timeliness, correctness, validity, morality, safety, applicability, usefulness, availability, or non-infringement of third-party rights of the Content. Users shall use the Service and the Content at their own risk and judgment.

6. Our company shall not be liable for any damages incurred by Users due to the use of the Service, except in cases of intentional or gross negligence on the part of our company.

7. In providing the Service, our company may collect and use part of the user information (such as Cookie information and advertising identifiers “IDFA/AndroidAdID,” hereinafter referred to as “Cookies, etc.”) through the device or browser for user analysis, measurement of advertising effectiveness, and optimal advertisement delivery including behavior-targeted advertising. Our company may also provide Cookies, etc., to third parties such as Google and its partner websites (hereinafter referred to as “Third-Party Delivery Businesses”) for the purpose of advertisement delivery. Third-Party Delivery Businesses use such Cookies, etc., to deliver advertisements to Users. Users who do not wish to receive such advertisements can disable them by accessing the advertising settings page (https://www.google.com/settings/ads) or by visiting http://www.aboutads.info/choices/ to disable the use of Cookies by Third-Party Delivery Businesses.

8. Our company may change the Terms without prior notice to Users if deemed necessary. The changed Terms will be effective from the time they are posted on our website. Continued use of the Service by Users after the change in Terms constitutes agreement to the changed Terms.

9. The Terms shall be governed by and construed in accordance with the laws of Japan.

10. Any litigation or other disputes related to the Service or the Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
